Daniel
DANIEL · UNASSIGNED (appealed) · Scalelist: UNDER REVIEW
Look
- Build & height: 1.85 m, long-limbed and upright as a mast-step, with a clerk's slight stoop he corrects whenever he notices it. Age 35 at debut (thirty on the founding day).
- Face: long and composed, clean-shaven every morning even in a gale. A straight nose, a quiet mouth, and an ink-callus on the middle finger of his right hand from fifteen years of copying. At rest he looks like a man waiting for someone else to finish speaking.
- Hair: short and dark, combed. It doesn't stay combed in a fight, so he combs it afterwards.
- Eyes: steady dark grey. They never glow. Nothing about him glows, except, while an appeal holds, one thin line across his palm.
- Skin & sin-mark: none, anywhere. Three Examiners, a Mirror-Ward and a nine-year-old with a lantern have checked. His is the only unmarked skin among the eight. While an appeal holds, a single paper-white line crosses his raised palm, like a ruled line on a blank page. It's the only mark he ever carries, and it fades when the hearing ends.
- Clothing, layer by layer: a white linen shirt buttoned to the throat · a dark waistcoat · the clean grey coat (Certification Stacks clerk's grey, knee-length, spotless in the middle of any mess: he brushes it after every fight, before he sees to his own wounds) · dark trousers and polished boots · a plain belt with a plain sword in a plain sheath · pilot's brass dividers in a coat pocket · the examination certificate, folded into eighths, in the left breast pocket, stamped APPEALED.
- Signature item: the certificate. He touches the pocket before every appeal.
- Movement: still and economical. He walks the deck in straight lines and turns at right angles.
- Voice: quiet, measured and precise, never raised. He says "Objection" the way you'd set a cup down on a table. His balloons are the only square-cornered balloons in the series, with a straight tail, and "Objection." always gets a thin double border, like an official stamp.
Power
Once per verdict, Daniel can demand that any judgement be heard again before a true witness. The judgement stops until it's heard.
- The words: "Objection." In full: "I appeal. Hear it again." His palm comes up as he says it.
- What counts as a judgement: anything that declares what someone is, or what must happen to them. A verdict, a sentence, a rank or a rank-stamp, a sin assignment, a decree or a writ, a law applied to a case (a salvage-claim), a bounty, an Arena outcome, an erasure (the world's verdict to forget someone).
- The stay: the instant he speaks, that one judgement stops. A stamp hangs in the air, a decree halts mid-word, an axe stops mid-swing, a board's number freezes mid-flicker. Only that judgement: the fight around it goes on. The stay holds for as long as his hand stays raised.
- The hearing needs a true witness: someone who saw the thing judged with their own eyes or ears, and who says what they saw aloud, freely and truly. Anyone can be one: a child, an enemy, a stranger. A lie makes someone no witness at all, and so does compulsion. He can ask for witnesses, but he can't make anyone answer, and he wouldn't.
- The balance: when the witness speaks, a balance of pale light appears, with the judgement in one pan and Daniel's name in the other, and the truth tips it.
- If the judgement was wrong, it cracks and falls.
- If it was right, or if his hand comes down before a true witness is heard, he loses.
- The price is the power: an appeal puts his own name in the balance. If he loses, the verdict is written on him instead. The person he appealed for goes free either way. The verdict will land on someone, and Daniel has volunteered to be the someone. (Appealing a death sentence means offering his own neck.)
- Once per verdict. He can never appeal the same judgement twice, and a lost appeal is final.
- The Arena rule: an Arena verdict can only be re-heard inside the Arena (Rule One: nothing outside can undo what was decided inside). Erasures can only be heard there too, because the erased can only be seen in the Arena's stands.
- His own rule: he never appeals a verdict its subject chose. Vigolas's yield to Smurjan stays a yield. ("Don't you dare." / "I wouldn't.")
- What it can't do:
- Mingus. There is no judgement on Mingus to appeal: no line, no rank, no plate ("That one cannot be placed."). Daniel has never tried, and never will.
- The Null. It doesn't judge; it subtracts. Uncounting isn't a verdict, so there's nothing there to appeal. "You can't appeal a hole." Even at Stage IV, when the Null chooses, its choice has no court, no witness and no count. He can appeal a writ's signature before it has been read and heard (paper is still a judgement), but never the grey once it has touched anyone. Phase One holds.
- Facts: a death, a wound, a punch, a storm. "Death isn't a verdict. It's weather."
- A Codex once read; a chosen verdict; anything twice.
HADOM, the heartbeat
- Tempo: 41. No Examiner has ever measured it, because measuring is a judgement and his is stayed. Jeppson clocked him with a pocket-watch.
- Heartbeat technique: THE STAYED BEAT. For one beat, nothing can be decided: no verdict lands, no rank changes, no decree takes, no ending is written, anywhere within the sound of his voice. Things still move and blows still fall, but nothing in that beat is final. It's a one-beat window in which every answer can still be changed. No one else holds a beat open for deciding. (Isa stops time inside a beat; Tihi takes a beat out of the count; Daniel leaves the beat in and takes the decisions out of it.)
- Burn cost (and the HADOM OVERFLOW rule): a stayed decision doesn't vanish. It waits in his heart for the length of the beat and lands in the next one. His heart can hold as many waiting decisions as it can count, which is 41. Stay a duel and he holds a handful. Stay a battlefield (a thousand small verdicts: who yields, who falls, whose rank moves) and the beat overflows: light at the sternum, a heart that can't close. He has to choose exactly what to stay. Against the Arbiter, a being made of every ending ever decided, one Stayed Beat would burst him instantly, unless he is standing inside Emma's circle.
Techniques
| Technique | What it does | Cost | First shown |
|---|---|---|---|
| APPEAL | "Objection." Any judgement stops until it's heard before a true witness | His own name in the balance; once per verdict | Founding day (backstory) · on the page Saga V, Arc 1 · Fyren (the Wreckers' salvage-law) |
| Call for Witnesses | He asks aloud for anyone who saw. Everyone who saw feels the question in their chest, and may answer or not | No one can be made to answer, so sometimes he is alone with his hand up | Saga V, Arc 1 |
| One Hand Raised | Fights one-handed (the plain sword in his left) while his right holds the stay. Defends the witness, never attacks | If the raised hand falls, he loses | Saga V, Arc 1 |
| THE STAYED BEAT | One beat in which nothing can be decided | Overflow past 41 held decisions | Saga V, Arc 1 (one small use: the Wreckers' Lamp-Court can't rule in the beat before Hallbard answers) · named Saga VI |
| The Highest Appeal | Enrolled through Rule Seven, he appeals the Arena itself before Fenna, the true witness | If he loses, the ending is written on him | Ch. 403–405 (UNDER REVIEW → APPEAL UPHELD → HEARD) |
The price
An appeal puts his own name in the balance. If he loses, the verdict is written on him instead. Every appeal is his neck, his rank, his memory or his freedom offered in someone else's place, so he chooses very carefully: four appeals in the five years before Saga V, and four won. He has never lost. He knows the day will come. On the page, every time: the hand raised and held (it aches, it shakes, and in a long hearing someone else has to hold it up for him), the white line on his palm, and his name hanging in the pale balance where the reader can see it. The quiet price: he has spent five years as the only blank page on any board, and he isn't sure there's anything under the blank.
Weaknesses
- No witness: a judgement made in secret, where nobody saw anything, can't be heard. It's the Order's favourite method.
- Witnesses silenced: killed, compelled, bribed or frightened. (Emma's circle and Tihi's giggle exist partly to stop this.)
- The hand: knock it down, knock him out, or wait until his arm gives out, and he loses.
- Once per verdict: a judgement he has already appealed and lost is final forever.
- Facts: he can't touch a death, a wound, a fact, the Null or Mingus.
- The body: a harbour-pilot's son and a clerk. With the plain sword he can parry an honest duellist for a minute or two, but a real fighter just knocks him down.
- Liars: a false witness is no witness, and an island where nobody tells the truth is a court he can't win in.
- The Arbiter: after Saga V it has a reason to hate him: a verdict re-heard.
- The Order's clerks, who know the old Charter, and plastered over it.
- His conscience: he won't appeal a verdict he thinks was just, even to save a friend.
Gear & companions
- The certificate: his examination slip, stamped APPEALED in bronze ink by Dock Examiner Sten Brask (BRASK · K-II MARKED · Rank Certification · the Examination Docks), with Brask's signature shaking at the end. Folded into eighths, the fold-lines nearly worn through. He touches the pocket before every appeal.
- The plain sword: his father's harbour-pilot's hanger, plain steel in a plain sheath. Drawn three times in five years, always to keep someone between a witness and a blade.
- The docket: a small black book where he writes every verdict he hears (fair or not, his or not) and every appeal he makes, won or lost. The last page is ruled and blank.
- Half the cracked seal: the bronze seal that split in two over his head on the founding day. He keeps one half as a paperweight on the chart table. Brask kept the other.
- The clean grey coat.
- Pilot's dividers and charts: he is the Upp Igen's navigator. His father taught him the Spine's fjords before he could read, and he plots by stars and by the shape of a current.
- The UPP IGEN: the broad, battered three-masted carrack, sunk five times and raised five times, five bands of differently coloured planks along her sides (Jeppson's cork-brown fallen-bark band at the rail), her bottom sheathed in bark-scrap so she can sail the Current, a bandaged fist for a figurehead and on her black flag, motto "UPP IGEN!". His chart table stands by the binnacle, the half-seal on the charts. She was raised on the night of his appeal.
How they fight
He doesn't fight; he holds. He opens with "Objection" at the first judgement in the fight that matters (a sentence, a claim, a bounty, a count), raises his hand, and keeps it there while the battle goes on around him. He fights one-handed only to keep a witness alive. He finishes when a witness speaks. He has never won a fight in his life, and he has never lost an appeal. Crew combos (the Up-Again crew):
- Daniel + Tihi, "the Witness and the Objection": the founding pair. Anyone who tries to stop a witness talking starts laughing and loses their grip.
- Daniel + Emma, "the Witness Ring": a witness inside her circle can't be compelled into silence or into a lie. And the Kept Stay: inside the ring, where no heart can overflow, his Stayed Beat can hold more decisions than his heart can count, and Emma pays. But he can never file an appeal from inside her line: an appeal compels a hearing, and nothing can be made to happen in there. They respect each other across her chalk.
- Daniel + Krydog: when a referee, a law or an Arena-keeper counts the captain out, Daniel says "Objection," and the count stops long enough for him to get up. Krydog calls him "the reason."
- Daniel + Flexsnus, "Bend and Appeal": Flexsnus bends the rule one notch, and Daniel appeals the verdict made under it. It's the shape of the Saga VI challenge. Daniel disapproves of him by about one notch.
- Daniel + Perne, "the Far Witness": she saw it from eleven miles away, so she is a true witness to things nobody else was near. He never calls her for the crew's own cases. He won't allow the bias.
- Daniel + Roffe: a witness who ate at Roffe's table can't be turned against the crew before the hearing.
- Daniel + Jeppson: a chalk witness-stand, built in a breath, that stands for an hour, which is usually long enough.
Marka combos:
- Daniel + Kompis: Lust-sight isn't truth-magic, but Kompis can see who a witness is tied to, and who they're afraid of. "She's not lying. She's terrified of the man on the left."
- Daniel + Öde: her Roll-Call makes her a true witness for everyone she remembers, the people nobody else alive saw.
- Daniel + Rougeina: the judge and the executioner. Heard Again.
- The best courtrooms in the Current: Orka's Dawnstar and Nässla's Nettle Field, where no lie survives. He would hold every hearing there if he could.
Personality
- Wants: for everyone to be heard once before they are written.
- Fears: being right and unheard. And, privately, the blank page: that there's nothing under it.
- Contradiction: the crew's judge has never passed a judgement. He only asks for them to be heard again. A man who loves rules, serving under a captain who treats them like weather.
- Humour: bone-dry legal language at exactly the wrong moment. Tihi: "I didn't eat it." Daniel: "Objection. Crumbs."
- Habits: brushes his coat after every fight, before his wounds; unfolds the certificate, reads APPEALED, folds it again; writes every verdict he hears into the docket; goes back once a year to the Examination Docks to ask whether his review has been closed.
- Alone: at the chart table at night, he reads the First Article aloud to nobody, so that someone has heard it this year.
Relationships
- Tihi: his first witness. She calls him "Objection"; he calls her "the witness", formally, every time. At eleven she asked him to find her mother's line in the Order's records, and he told her the truth because she asked for it. She laughed, because she had to, and he sat with her until she stopped. He is the one person she has never made laugh. (Saga VI.)
- Emma: the judge and the conscience. He believes in hearings; she believes in nobody being made to do anything. He can't file an appeal from inside her line, and they've argued about that across her chalk for five years, very politely.
- Krydog: his captain. "The reason." Their dream is the same one, argued two ways: Krydog's with a fist (anybody can get up), Daniel's with a law (anybody can be heard again).
- Perne: the best eyes in the Current, and he never uses them for the crew's own cases.
- Flexsnus: the only man who bet on him. "Bend and Appeal."
- Rougeina: the judge and the executioner. He disapproves of her list, and she disapproves of anything that sounds like the Order's paperwork. He appeals one of her erasures, the only time anyone does, and the Arena hears it. Afterwards she reads him the rest of her names at night, one by one.
- Vigolas: two dreams. "You want no court." / "I want every court answerable. Then we'll see if we need them." And the yield: "Don't you dare." / "I wouldn't."
- Hallbard: his first witness on the page (Saga V, Arc 1).
- The Arbiter: the respondent.
Story so far
- IV · The Twelfth Chair: ch. 199: the anniversary visit, the Tideline, the rejects carried out. ch. 230: far off in Hallbard's beam, the Upp Igen racing the Marka toward the Mouth.
- V · The Current:
- Arc 1 · Fyren (spotlight, with Krydog): Daniel's first appeal on the page. The Wreckers' false lamp puts the Upp Igen on Fyren's rocks, and their salvage-law (what the rocks take, the rocks keep) declares her theirs, crew and all. Daniel raises his hand: "Objection. Salvage requires a wreck. This was a lure." His name is in the balance (if he loses, he is salvage). He won't call Perne, because she's crew; he calls Hallbard, the man whose Beam swept the false lamp and who has never lied about what his light touched (it's in the Keeper's Log). The balance tips, and the claim cracks. The Marka crew watch a stranger risk himself on a law in a cave of thieves, and Vigolas asks why. "It was wrong. Also, I'd like to beat you to the Mouth fairly."
- VI · The Third Sign: DANIEL FILES THE CHALLENGE. He appeals the Arena itself before a true witness, Fenna, with his own name in the balance.
- Daniel has reasoned out the sealed rule; Flexsnus speaks it aloud and bends it one notch, which enrolls the whole Upp Igen, Daniel with it.
- He steps out of Emma's Great Ring to file (an appeal compels a hearing, and nothing can be compelled inside her line), and she can't compel him back in. "I can't make you stay." / "I know. That's why I trust it."
- "Objection. I appeal the Arena." His hand comes up. The Arbiter's ending stops until it is heard. It cannot land while his hand is raised.
- His name is in the balance: if he loses, the ending is written on him, and he becomes one more frozen final moment in the Arbiter's body. From the hem up, his clean grey coat begins to go still.
- When his own arm can't hold the stay any longer, the crew hold it up for him, one hand after another ("UPP IGEN!"). When even that falters and the stillness reaches his collar, Krydog shoves him one step back, so that one boot lands on Emma's line. There he spends the Stayed Beat, one beat in which no ending can be written. Against the Arbiter it would burst any heart outside her circle. Emma pays. In that beat, the witness speaks. (The rule that makes this work: an appeal can't be filed from inside her line, because filing compels a court to sit. Once it's filed, the stay is only his raised hand, and it holds wherever he stands.)
- Tihi laughs at him going grey, on purpose, and Daniel laughs for the first time in the series.
- The appeal is upheld. The ending is struck. The Arena becomes answerable: the Free Arena, where every verdict carries its own appeal. For the first time since the founding, his Scalelist field changes: UNDER REVIEW → HEARD. There is still no sin-mark. What stays: his right hand is grey to the wrist, and cold: the last unfinished ending in the world.
- VI · Arc 1–7: "It wants a final match. One with no appeal." / "There's always an appeal, friend." / "I know that." (ch. 333). Arc 2, the Cut: to a Mender's needle, "I'd rather be heard than finished." (ch. 344); appeals the Cut itself and gets nothing: "There's no verdict. Nobody judged him. They just… did it." (ch. 346); won't file while the subject wants it (ch. 347); then appeals the writ: "Objection." tak., the Great Seam frozen mid-pull ("It isn't a match. It's a sentence. Sentences can be heard.") and "I need a true witness. Someone who saw this wound made." (ch. 348); asks the subject first ("Do you choose it?" / "I want it." / "That's not what I asked." / "…Nobody ever asked me anything." / "I'm asking."), Dolk testifies, krk, the letters burn out: "A bond can be appealed. A cut can't."; the healed inch he leaves alone ("He let that one in. I don't touch what's chosen.", ch. 349); docket: DOLK. Heard., a strip folded into eighths beside the certificate (ch. 350). Calls the fleet's vote: "It's not a verdict. It's a vote." (ch. 362). "That's a court with no appeal." / "I'm wondering if it does." (ch. 371); of the first ending: "That's not an attack. That's a verdict." (ch. 372); his three-page recipe and one onion for Roffe (ch. 379); "I'll be watching the rules." (ch. 380). A hand half-raised at Rule Five: "There's no verdict yet." (ch. 385); "It sealed the floor. She made the seal hold for them too." (ch. 387); "That's an invitation." (ch. 390). The Null's offer: "It's an offer. There's nothing to object to." (ch. 394); the Null counted: "Then it can lose." (ch. 400).
- VI · Arc 8: sees Fenna: "The true witness. She exists." Files ("I can't make you stay." / "I know. That's why I trust it."; to Tihi: "Witness. You're my first witness. Watch."): "Objection. I appeal the Arena." THE END. stops; UNDER REVIEW. Coat still from the hem up. Exhibit One: the verdict cube (ONE MATCH. OF MANY without a full stop): "Your own sentence has no full stop. You can't end a story you never finished writing." The crew hold his arm ("Objection… sustained."); Krydog falls sideways and puts his heel on Emma's line; THE STAYED BEAT (Emma pays: her eyelashes go white); "The witness may speak." Ch. 405: he laughs, for the first time in the series; APPEAL UPHELD.; UNDER REVIEW → DANIEL · UNASSIGNED · Scalelist: HEARD; his right hand stays grey to the wrist ("The last unfinished ending in the world. I'll keep it."); every ending the Arena wrote in this match struck: the Free Arena. Of the Null: "It was never evil. It was just lost." (ch. 408).
- VI · Arc 9: on Krydog's sleep, Same Way Twice wiped: "He's never been this available."
